Article 101 TFEU (ex Article 81 TEC) prohibits, as incompatible with the internal market, all agreements between undertakings, decisions by associations of undertakings, and concerted practices that may affect trade between Member States and have as their object or effect the prevention, restriction, or distortion of competition, with specific prohibited conduct including price-fixing, market sharing, output limitation, discriminatory trading conditions, and tying arrangements. Any agreement or decision in breach of paragraph 1 is automatically void. Paragraph 3 provides for an exemption where the arrangement contributes to improving production or distribution of goods or promoting technical or economic progress, allows consumers a fair share of the resulting benefit, and does not impose indispensable restrictions or eliminate competition in respect of a substantial part of the products concerned.AI
