Article 267 TFEU (ex Article 234 TEC) confers jurisdiction on the Court of Justice of the European Union to issue preliminary rulings on the interpretation of the Treaties and on the validity and interpretation of acts of Union institutions, bodies, offices, or agencies. National courts or tribunals may refer such questions where a ruling is necessary to decide a pending case, while courts of last instance—against whose decisions no judicial remedy exists under national law—are obliged to make such a reference.
