Council of the European Union and European Parliament 16 December 1996, Directive 96/71/EC of the European Parliament and of the Council of 16 December 1996 concerning the posting of workers in the framework of the provision of services
Also known as
Directive 96/71/EC establishes a regulatory framework for the transnational posting of workers within the European Union to ensure fair competition and the protection of workers' rights during the temporary provision of services. It mandates that Member States guarantee posted workers a 'hard core' of terms and conditions of employment, including minimum rates of pay and maximum work periods, as defined by the host State's laws or universally applicable collective agreements. The Directive further provides for administrative cooperation between national authorities, judicial jurisdiction in the host Member State, and implementation deadlines for Member States.AI
