Council Common Position 2008/944/CFSP of 8 December 2008 establishes binding common rules governing EU Member States' control of exports of military technology and equipment, updating and replacing the 1998 EU Code of Conduct on Arms Exports. The instrument sets out eight criteria against which Member States must assess export licence applications on a case-by-case basis, covering respect for international obligations, human rights, internal stability, regional security, national security interests, buyer-country conduct, diversion risks, and economic compatibility of the recipient country. Member States retain national discretion over individual licensing decisions but are required to consult one another before granting licences previously denied by another Member State, to circulate denial notifications, and to publish annual reports on their exports in implementation of the Common Position.AI
