Council Framework Decision 2008/675/JHA of 24 July 2008 establishes a minimum obligation for EU Member States to take into account, in the course of new criminal proceedings, previous convictions handed down against the same person in other Member States, attaching to such convictions effects equivalent to those attached to prior national convictions in accordance with national law. The obligation applies at the pre-trial, trial, and execution stages, but does not require Member States to interfere with, revoke, or review prior foreign convictions, and does not apply where taking such convictions into account would produce those effects under national law. Member States were required to transpose the Framework Decision by 15 August 2010, and it replaces Article 56 of the European Convention of 28 May 1970 on the International Validity of Criminal Judgments as between Member States parties to that Convention.AI
