Council Framework Decision 2008/841/JHA of 24 October 2008 establishes a common EU framework to combat organised crime by requiring Member States to criminalise participation in a criminal organisation—defined as a structured association of more than two persons acting in concert to commit offences punishable by at least four years' deprivation of liberty for financial or material gain—through either active participation or conspiracy. Key provisions mandate maximum imprisonment terms of at least two to five years, allow penalty reductions for cooperating offenders, and impose liability on both natural and legal persons, including fines, disqualification, and judicial winding-up for the latter. Member States were required to transpose the Decision into national law by 11 May 2010, and the Decision repealed Joint Action 98/733/JHA.AI
