Council Framework Decision 2009/315/JHA establishes a mandatory system for the exchange of criminal record information between EU Member States, requiring convicting Member States to transmit conviction data to the Member State of the convicted person's nationality, which must store and retransmit such information upon request. Key provisions define the obligations of central authorities, the categories of information to be transmitted (including disqualifications arising from convictions), deadlines for replies, and conditions governing the use of personal data, with the aim of preventing convicted persons—particularly those convicted of sexual offences against children—from concealing convictions when seeking professional activity in another Member State. Member States were required to implement the Framework Decision by 27 April 2012, by which date electronic transmission using a standardised format was to replace prior paper-based procedures, and the Framework Decision replaces Article 22 of the European Convention on Mutual Assistance in Criminal Matters as between Member States.AI
