Council of the European Union and European Parliament 17 April 2019, Directive (EU) 2019/884 of the European Parliament and of the Council of 17 April 2019 amending Council Framework Decision 2009/315/JHA, as regards the exchange of information on third-country nationals and as regards the European Criminal Records Information System (ECRIS), and replacing Council Decision 2009/316/JHA

Also known as

Directive (EU) 2019/884 amends Council Framework Decision 2009/315/JHA to address deficiencies in the exchange of criminal records information concerning third-country nationals within the European Criminal Records Information System (ECRIS), replacing Council Decision 2009/316/JHA. Key provisions require convicting Member States to record the nationality of convicted third-country nationals, introduce a targeted request procedure whereby a Member State responds only to those Member States identified as holding relevant records (facilitated by the ECRIS-TCN centralised system established under Regulation (EU) 2019/816), and formalise the technical and institutional framework for ECRIS, including the role of eu-LISA and Commission implementing powers. Member States are required to transpose the Directive and complete necessary technical alterations by 28 June 2022, with Denmark and Ireland not participating by virtue of their respective Protocols.AI
