Regulation (EU) 2025/1561 amends Regulation (EU) 2023/1542 to postpone by two years the date of application of battery due diligence obligations—covering the sourcing, processing, and trading of cobalt, natural graphite, lithium, and nickel used in battery manufacturing—from 18 August 2025 to 18 August 2027, on the basis of Article 114 TFEU. The postponement is justified by delays in the designation of notified conformity assessment bodies and the incomplete development and recognition of due diligence schemes, as well as the need to ensure consistency with Directive (EU) 2024/1760 on corporate sustainability due diligence. The Regulation also adjusts the deadline for the Commission's publication of due diligence guidelines from 18 February 2025 to 26 July 2026, and entered into force on 31 July 2025, the day following its publication in the Official Journal.AI
