Commission Implementing Decision (EU) 2026/1750 of 20 July 2026 determines that harmonised standards EN 17476:2021 (as amended by EN 17476:2021/A1:2022) and EN 497:2022, drafted in support of Regulation (EU) 2016/426 on appliances burning gaseous fuels, fail to meet the essential health and safety requirements set out in Annex I to that Regulation. The decisive legal issue is whether those standards satisfy the essential requirements under Article 13 of Regulation (EU) 2016/426, which conditions the presumption of conformity on compliance with such requirements; formal objections raised by Sweden and Germany under Article 11 of Regulation (EU) No 1025/2012 identified deficiencies including inadequate provisions for safe operation at low temperatures and on inclined surfaces, absence of flame-supervision device requirements, insufficient marking requirements, and failure to address risks from incorrect reassembly. The Commission accordingly decided, pursuant to Article 11(1)(a) of Regulation (EU) No 1025/2012, not to publish the references of either standard in the Official Journal of the European Union.AI
