Commission Implementing Regulation (EU) 2026/1341 initiates a new exporter review under Article 13(4) of Regulation (EU) 2016/1036 and Article 23(6) of Regulation (EU) 2016/1037 to determine whether Braya Renewable Fuels (Newfoundland) LP, a Canadian exporting producer legally established in 2014 with a plant opened in 2024, should be exempted from the anti-dumping and countervailing measures extended to biodiesel consigned from Canada by Implementing Regulations (EU) No 443/2011 and (EU) No 444/2011, on the basis that the applicant did not export during the original investigation period (1 April 2009 to 30 June 2010). Pending the outcome of the review, the anti-dumping duty imposed by Implementing Regulation (EU) 2021/1266 is repealed with respect to the applicant's imports, while the countervailing duty under Implementing Regulation (EU) 2021/1267 remains in force, and the applicant's imports are subject to customs registration to enable retroactive duty collection (up to 172.2 EUR/tonne) should circumvention be found. The investigation covers the period from 1 April 2009 to 31 March 2026 and must be concluded within nine months of the entry into force of this Regulation.AI
