This Commission proposal (COM(2017) 344 final) establishes, under Article 82(1)(d) TFEU, a centralised EU-level system (ECRIS-TCN) to identify which Member States hold criminal conviction information on third-country nationals and stateless persons, to be developed and operationally managed by eu-LISA. Key provisions require convicting Member States to create data records containing alphanumeric data, fingerprints, and facial images for each convicted third-country national, mandate competent authorities to query the system before requesting full criminal records via the existing ECRIS, and impose strict data protection obligations supplementing Directive (EU) 2016/680 and Regulation (EC) No 45/2001, with direct access granted to Eurojust, Europol, and the European Public Prosecutor's Office. The Regulation amends Regulation (EU) No 1077/2011 to reflect eu-LISA's expanded mandate and is intended to complement the Commission's January 2016 proposal for a Directive amending Framework Decision 2009/315/JHA.AI
