Commission Staff Working Document accompanying COM(2018) 32 identifies regulatory frictions at the interface of EU chemicals, product and waste legislation that impede safe circular material flows, notably inadequate information on substances of concern, legacy substances in recycled materials, divergent end-of-waste determinations, and inconsistent hazardous-waste classification. It presents non-binding policy options concerning substance tracking, equal or conditional rules for primary and secondary materials, enforcement for imported articles, circular product design, harmonisation of end-of-waste criteria and alignment of waste classification with the CLP Regulation. The Commission envisages consultation and further discussions to select actions supporting sustainable secondary-raw-material markets while maintaining human-health and environmental protection.AI
