OPINION OF MR ADVOCATE-GENERAL ROEMER DELIVERED ON 30 OCTOBER 1962 ( 1 ) Mr President, Members of the Court, The Commission of the European Economic Community which, in accordance with the Treaty, supervises the application of its provisions in order to ensure the proper functioning and development of the Common Market (Article 155), has instituted two actions, under Article 169, against the
