OPINION OF MR ADVOCATE GENERAL WARNER DELIVERED ON 24 APRIL 1980 My Lords, This case comes before the Court by way of a reference for a preliminary ruling by the Finanzgericht of Hamburg. The plaintiff in the proceedings before the Finanzgericht is the Firma Gedelfi Großeinkauf GmbH & Co., KG (which I shall call “Gedelfi”). The defendant is the Hauptzollamt Hamburg-Jonas.
