OPINION OF MR ADVOCATE GENERAL WARNER DELIVERED ON 10 JUNE 1980 My Lords, This case comes before the Court by way of a reference for a preliminary ruling by the Sozialgericht of Augsburg. The plaintiffs in the proceedings before that Court are the five children of Mr Francesco Gravina, an Italian worker who died in the Federal Republic of Germany on 6 July 1973.
