OPINION OF MR ADVOCATE GENERAL WARNER DELIVERED ON 11 FEBRUARY 1981 My Lords, This case comes before the Court by way of a reference for a preliminary ruling by a Social Security Commissioner, sitting in London. “Social Security Commissioner” is, so we are told, the new name of what was until recently called a National Insurance Commissioner. I shall refer to him simply as “the Commissioner”.
