In this case, the Commission asks the Court to declare that the Law on Charges for the Use of Federal Motorways by Heavy Lorries of 30 April 1990 (the "Strassenbenutzungs-gebuehrengesetz", hereafter "StrBG") is contrary to Articles 76, 95 and 5 of the EEC Treaty.
