In the context of its jurisdiction under Article 181 of the EC Treaty, the Court of Justice has received an application from the Commission of the European Communities for an order that Van Balkom Non-Ferro Scheiding BV (hereinafter Balkom), a company with which the Commission concluded a contract, reimburse to the Commission an
