By an order of 16 May 2002 the Tribunal Supremo (Supreme Court) (Spain) referred to the Court for a preliminary ruling pursuant to Article 234 EC two questions on the interpretation of Directive 97/67/EC of the European Parliament and of the Council of 15 December 1997 on common rules for the development of the
