In this case, the Commission appeals against a judgment of the Court of First Instance (2) declaring admissible an application brought by Jégo-Quéré et Cie SA (hereafter ‘Jégo-Quéré’) under the fourth paragraph of Article 230 EC for the annulment of Articles 3(d) and 5 of Commission Regulation (EC) No 1162/2001 of 14 June 2001
