In this case the Tribunal Supremo of Spain has referred to the Court a question concerning the scope of the obligation of prior notification under Article 88(3) EC, in conjunction with Council Directive 90/684/EEC of 21 December 1990 on aid to shipbuilding (the ‘seventh Directive’).
