The present case, a preliminary reference from the Oberlandesgericht (Higher Regional Court of Appeal) Hamm, concerns the interpretation of Article 16(1)(a) of the Brussels Convention on jurisdiction and the enforcement of judgments in civil and commercial matters (the ‘Convention’).
