In this request for a preliminary ruling, the Sección Primera de la Audiencia Provincial de Málaga (First Section, Provincial Court, Málaga) (the ‘referring court’) seeks clarification of the scope of the principle of ne bis in idem embodied in Article 54 of the Convention implementing the Schengen Agreement (‘CISA’).
