Opinion of the Advocate-General Opinion of the Advocate-General 1. Article 9(1)(c) of Council Regulation (EC) No 40/94 (‘the Regulation’) (2) allows the proprietor of a Community trade mark which has a ‘reputation in the Community’ to prevent the use of certain signs, identical or similar to that mark, for goods or services which are not similar to those for which it is registered.
