General Court (Eighth Chamber) 10 December 2015, T-512/12 (Front populaire pour la libération de la saguia-el-hamra et du rio de oro (Front Polisario) v Council of the European Union.)

Also known as

The General Court of the European Union annulled Council Decision 2012/497/EU insofar as it approved the application of a trade liberalization agreement with Morocco to the disputed territory of Western Sahara. While the Court found no absolute prohibition under international law against concluding agreements applicable to disputed territories, it held that the Council failed to fulfill its obligation to examine whether the exploitation of natural resources in that territory would be to the detriment of the local population or infringe upon their fundamental rights. The Court further affirmed the legal capacity of the Front Polisario to bring an action for annulment as a 'legal person' directly and individually concerned by the decision due to its status in UN-led negotiations regarding the territory's sovereignty.AI
