In an action for annulment brought by the European Parliament against the Council concerning Decision 2014/198/CFSP on the conclusion of the EU-Tanzania Agreement on the transfer of suspected pirates, the Court of Justice held that the decision was legitimately founded on Article 37 TEU alone because the agreement predominantly pursued Common Foreign and Security Policy objectives. However, the Court found that the Council infringed an essential procedural requirement under Article 218(10) TFEU by failing to keep the Parliament immediately and fully informed at all stages of the negotiation and conclusion procedure, including failing to transmit the draft and final texts. Consequently, the Court annulled Council Decision 2014/198/CFSP but ordered that its effects be maintained pursuant to the second paragraph of Article 264 TFEU.AI
