In an appeal concerning the resolution of Banco Popular Español S.A., the Court of Justice (First Chamber) set aside the General Court's judgment and held that, for the purposes of the information obligation under Article 15(1)(d) of Regulation (EU) 2018/1725, the identifiable nature of data subjects must be assessed at the time of data collection and from the perspective of the controller, not from the perspective of the recipient to whom pseudonymised data are subsequently transferred. The Court further held that personal opinions or views expressed by data subjects are, by their very nature, information relating to those persons within the meaning of Article 3(1) of that Regulation, without requiring a separate examination of the content, purpose, or effect of such information. The case was referred back to the General Court for examination of the second plea in law, which involved factual assessments not previously addressed.AI
