The General Court (Tenth Chamber) dismissed Meta Platforms Ireland Ltd's action against EDPB Opinion 8/2024 on 'consent or pay' models, holding that the opinion, adopted under Article 64(2) of Regulation (EU) 2016/679, does not produce binding legal effects capable of affecting Meta's legal position and therefore constitutes an act not open to challenge under Article 263 TFEU. The claim for annulment was declared inadmissible, and the Court further held that the non-contractual liability claim was manifestly unfounded because the alleged damage—reduced advertising and subscription revenues—was based on future and uncertain events and no sufficiently direct causal link existed between the non-binding opinion and the damage alleged. Meta was ordered to bear its own costs and pay those of the EDPB.AI
