The General Court dismissed the action for annulment brought by Kingspan Group plc against the European Commission's decisions refusing access to certain documents during an investigation under Article 14(1) of Regulation (EC) No 139/2004. The Court found that the contested decisions were intermediate procedural measures that do not produce binding legal effects and therefore are not challengeable acts. Consequently, Kingspan Group was ordered to bear its own costs and pay those incurred by the Commission.AI
