Directive 2000/60/EC sets out in Article 4(7) that Member States will not be in breach of the Directive if the objectives are not met as a result of ‘new modifications to the physical characteristics of surface water body’. Since the Directive entered into force in December 2000, the project may be considered as a new modification once it is no longer at the planning stage.
