Leitsatz 1. Der noch zu § 16 Abs. 3 Satz 3 TKV 1997 aufgestellte Maßstab des § 276 Abs. 1 BGB (BGH, 16. März 2006, III ZR 152/05, BGHZ 166, 369 Rn. 20 und 4. März 2004, III ZR 96/03, BGHZ 158, 201, 205 ff) gilt auch für § 45i Abs. 4 Satz 1 TKG.
