LORD CLARKE: Introduction This is the judgment of the Board with which Lord Mance and Sir Robin Auld have agreed but to which they have added concurring judgments, with which I agree. On 22 April 1989 there came into force in Guernsey the Trusts (Guernsey) Law 1989 (“the 1989 Law”), which for the first time made statutory provision for Guernsey trusts.
