delivered the opinion of the Court.

We are of opinion that the Court below erred in rejecting the testimony offered, and also erred in refusing to give to the Jury the instructions prayed for on behalf of the plaintiff.

Let the judgment be reversed, and the cause be remanded.

Judge Minor having been of counsel, did not sit.
