The motion- for a new trial, founds ed on affidavits in the County Court, and brought up from the County Court on exceptions, the affidavits accompanying, has been argued on both sides, neither seeming to suspect but what the subject is fairly before this Court. We are inclined to dispose of this motion, and a similar one in another cause, in the outset.
