This is an appeal from the judgment of the Superior Court of New Hanover, refusing to set aside a judgment rendered in that Court in favour of the plaintiffs against the defendant. No counsel has appeared here in behalf of the defendant, to shew the objections taken by him to the original judgment. One of these however is obvious on inspection of the record.
