The facts of this case are as follows: S. Broughton was the sheriff of Stewart county; on the 12th day of April, 1844, an execution from the Chancery Court at Clarksville, in favor of Allen, Carter and others, against Wm. B. Cherry, came to his hands, which was returnable to the September term, 1844, of said court.
