Dugan, as administrator, sued Fowler in debt on a forthcoming bond, executed to the plaintiff’s intestate by John H. Cocke, as principal, and William Cummins, and the defendant as his securities for the delivery of slaves seized in execution as the property of Cocke, to satisfy a judgment in favor of plaintiff’s intestate against said Cocke.
