The note under seal sued upon was given by the defendant to B. C. Hurley, for three hundred dollars, ini March, 1849, due the next October. It was endorsed to the plaintiffs in May of the same year. Tire consideration was the donation right to nine quarter sections of land in the State of Arkansas, of which a conveyance was made at the same time.
