Without deciding the question whether the legislature of the territory of Iowa had any power or authority to authorize David W. Fisher to build a ware house on the public ground of the town of Lyons; and without deciding what right or interest in the said public grounds passed to said Fisher and to his assignees, the present complainants, by virtue of the act of January 19th, 1846;
