This case' came into court on an appeal from the decision of the auditor-general and State treasurer, who, on the second day of September, 1864, settled an account against the defendent charging it with a tax on the tonnage carried over its road between the first day of May and the first day *346of July, 1864, pursuant to the provisions of the act of April 30th, 1864.
