It is not enough that a man is guilty ; his guilt must be proved according to the law of the land, before he can be punished. This principle is set out in “ the Declaration of Rights,” as a sacred guaranty necessary foiqthe protection of life and liberty.

The prisoner is indicted under the act of 16th February, 1871.
