This cause originated before a Justice of the Peace and the sole question is whether the Circuit Court had any jurisdiction to try it on appeal from his judgment. It was an,action upon an account for $50; 'the defendant was duly summonsed; the parties appeared on the day of trial and the case was tried before a jury, who found a verdict for the defendant.
