The admitted facts and uncontradicted evidence in this case are in substance as follows: On March 1, 1872, the town of Boulder, Colorado, which in 1881 became a city of the second class, and is the defendant in this action, issued certain bonds in aid of the Boulder Valley Bail way Company.
