The following narrative of facts abridged from the bill, answers and evidence, will sufficiently indicate the question to be determined.

Samuel F. Hersey bequeathed to the City of Bangor $100,000 " the principal to be held in trust, and the income thereof applied and appropriated by said city for the promotion of education, ” etc.
