McADAM, J.
The plaintiff was a fireman attached to engine company No. 20, being driver of the hose cart which formed part of the company’s outfit. On November 20, 1892, upon the receipt at company quarters of an alarm of fire, at about 1:30 a. m., he got into his seat, and drove towards the fire as fast as he could; going through Marion street into Broome, east towards the Bowery.
