On the 14bh day of September, 1893, the appellee instituted a suit against the appellant, in *12what is now the Southern district oí the United States court in the Indian Territory, at Ardmore, for damages claimed to have been received while appellee was a passenger upon appellant’s train, aud while she was endeavoring to alight from the train, at the station of Pauls Valley, Ind.
