GANTT, P. J.

The defendant was indicted at the September term, 1897, of the Marion Circuit Court, for robbery in the first degree. He was duly arraigned, tried, convicted' and sentenced to the penitentiary of Missouri for five years.

We are asked to reverse the judgment on four grounds. These will be examined and discussed in the order of defendant’s brief.
