The uncontradicted facts in this case are substantially as follows, namely :

On the 7th day of October, 189G, one William W. Eiclrard, then of Providence but now in parts unknown, acting as the agent of the defendant, sold two lots of land to the plaintiffs at public auction for the sum of $1,205.
