A motion is on file in this, court, made by appellee, to strike out the statement of facts because it was not filed in time. The case was tried in the District Court of Comal County, and on the 5th day of September, 1901, the court entered an order granting the appellant ten days after adjournment of court in which to prepare and file a statement of facts.
